Export
- A maximum of 4 cars in a 40/45' container. 2 cars per 20' container. Any shipments with inland movement via rail are restricted to ‘all 4 wheels on the floor of the container’ (2 cars per 40/45' or 1 car per 20'). Bookings considered hazardous until drain and disconnect letter received. Shipper must present ownership papers to US Customs for clearance to export.
- As of 2/1/2009, for all US exports, the U.S. Customs & Border Protection and US Bureau of Census have made it mandatory to file SED (Shippers Export Declaration) data electronically using an automated system known as AES (Automated Export System). For vessel exports, the filing must be completed and proof of same submitted to the exporting carrier no later than 24 hours prior to cargo loading.
- In order to allow for proper operational planning, SeaLand has established an AES documentation cut-off of 12 hours prior to cargo cut-off at the port of load. Shipment without AES proof at the time of the SeaLand AES documentation cut-off will not be loaded to the intended vessel. All entities and carriers exporting from the US must be compliant with all AES policies/procedures. If cargo is controlled outside the USA, AES is still required. A US agent must be selected by the foreign party if there is no US exporter to file.

When shipping to Nicaragua all transport documents must have the cargo description manifested in Spanish (description in English can be manifested but an extra line with description in Spanish must be added) based on Article 44 of the Regulation of the Central American Uniform Customs Code (RECAUCA).
- We do not offer US Flagged vessels
- Personal Effects or Household Goods CANNOT be railed cross border, either Canada to USA OR USA to Canada. Door deliveries for personal effects or household goods are prohibited in the USA. A clearing Agent in the USA is required. As per the dry acceptance manual, personal effects shall only be accepted through a forwarder.
- Placard and Marking placement for Rail Cargo - Due to the well car usage on all rails (Double Stack), containers being placed in a well car first, sit approximately 3.5 feet down, therefore placards placed low on the container will be hidden from view once in the car. Therefore, all containers that move on the rail in North America, must have placards affixed to the container 5 feet above the bottom rail.

Tariff
- Reefer demurrage includes plug-in/electricity charges.
- Reefer container with IMO follows Reefer.
- Non-operating reefer (NOR) is considered as Dry Container.
- Non-operating reefer (NOR) is considered as Dry Container for both Demurrage and Detention.
- Shipper's own containers (SOC) are not subject to detention and are subject to demurrage.
- For Shipper’s own containers (SOC) at non NWK locations, we have a single SOC DMR rate (no matter cntr/cargo type). At NWK locations, we have a separate SOC DMR rate and a Tank DMR rate.
Export Detention
- Free time for carrier’s equipment commences on the day equipment departs from carrier’s container yard.
- Working Day are defined as any day with operating gates and will be counted as working days for full loads received at terminals. These days will be countable days within the free time period for detention
- If a return location is closed for a full working day during the freetime period, or requiring dual transactions for return, and an alternate return location is not available within the same geographical area, the day will not count against the cargo freetime. Partial day closures are considered as a full working day and count towards freetime. When freetime expires, detention will accrue for each day irrespective of whether the facility is open or closed, given the full freetime period was given to ingate the cargo.
- For export detention, if the earliest receipt date publicly communicated by the terminal changes for a shipment while the container is in the customer’s possession for stuffing and within its free time period, we will extend the detention free time by the number of working days between the previous earliest receipt date and new earliest receipt date for the shipment.

Export Demurrage
- Free time will commence on the first calendar day following the equipment's arrival at the loading port. Free time is 7 calendar days including Saturday, Sunday, and holidays. After expiration of free time, equipment remaining on the loading port will be assessed demurrage as follows:
- For containers in-gated prior to the shipment’s earliest receipt date, but loads its originally scheduled vessel, demurrage will apply for each calendar day including Saturdays, Sundays, and holidays prior to the earliest receipt date.
- For containers in-gated before, on, or after the earliest receipt date, and do not load its originally scheduled vessel for any reason not a result of Carrier error, demurrage will apply per calendar day including Saturdays, Sundays and holidays until the cargo loads, or scheduled vessel sail date, whichever event occurs first.

Demurrage & Detention Disputes
- Demurrage and Detention disputes for U.S. shipments can be raised through our website www.sealandmaersk.com in the MyFinance section. In the event you wish to change the party invoiced, please e-mail disputes.AMR@sealandmaersk.com for assistance.
- When registering a dispute, please include the shipment number, container number, and a detailed description of the dispute including the applicable service contract number if pertinent to the claim. For disputes involving a change of paying party, written confirmation from the party who will pay is needed.
- Disputes must be submitted to Sealand within 30 days of the invoice date. We will provide feedback on your dispute within 5 business days of receipt.
Important Notes:
- Equipment must be returned to the receipt location as designated by carrier.
Detention is the daily charge against the ocean carrier's equipment, for the use of the equipment beyond allowed free time, as stipulated per tariff or contract. For carrier arranged haulage on a Store Door (SD) billing lading, detention will be assessed to the shipper/consignee. For merchant arranged haulage on a Container Yard (CY) bill of lading, detention will be assessed to the drayman, or at the carrier’s option to the shipper or consignee. Working days are used to calculate free time, whereas calendar days are used to calculate detention charges beyond free time.
Store Door Delivery
- Live Load/Unload Service - A live load/unload occurs when the driver waits with the tractor for the container to be loaded/unloaded. Free time for loading/unloading is 2 hours. Shipper will be assessed USD 125 per hour or portion thereof for trucker's waiting time beyond the 2 hours.
- Store Door Detention Free time Privileges for Drop and Pick activities
- Shipper may at their own discretion notify carrier when the container is empty and available for pick-up from the consignee's designated delivery facility. Notifications must be sent via the website: http://namemptymaersk.com
- Carrier will stop the detention clock effective the next business day after the notification is received.
- Additional Drays - If in the event carrier is instructed to drop the import load by the consignee, their agent or warehouse and a return unit is not available for immediate return carrier shall bill consignee for an additional round trip drayage charge as per carrier's inland tariff. Consignee will have the option to return the empty equipment within 7 calendar days at their cost once notified by carrier.
